COMPLIANCE

Reinstatement Procedures
Staff requested a clarification regarding whether or not the Board would honor, on a case by case basis, a request for reinstatement without requiring the individual to pay the fine associated with the suspension. The question is: Would such a request, submitted in accordance with Article XV, Section 7, of the Charter and Bylaws of The American Kennel Club, be granted to individuals who have been suspended for record keeping and dog identification violations? There was discussion that a new policy would include consistent criteria, including a re-inspection requirement, adherence to AKC’s Care and Conditions policy and reinstatement fees to cover AKC’s expenses. This will be discussed further in May. The Board will also review the penalties levied for registration violations.

Mr. Mike Keeter (Selah, WA) Action was taken by the Superstition Kennel Club for conduct in connection with its March 2, 2008 companion dog event. Specifically, Mr. Keeter was charged with personal property damage. The Staff Event Committee reviewed the event committee’s report, found it in order, and set the penalty at a reprimand and a $100 fine. (Flat-Coated Retriever)

Mr. Robert Jeffers (Odessa, FL) Action was taken by the Marion Alachua Dog Training Association for conduct in connection with its February 16, 2008 event. Specifically, Mr. Jeffers was charged with failure to control a dog at an event. The Staff Event Committee reviewed the event committee’s report, found it in order, and set the penalty at a reprimand and a $200 fine. (German Shepherd Dog)

The AKC’s Management Disciplinary Committee has suspended the following individuals from all AKC privileges for ten years, effective March 10, 2008 and imposed a $2000 fine for conduct prejudicial to purebred dogs, purebred dog events, or to the best interests of The American Kennel Club based on their violation of the AKC’s Cruelty Conviction Policy:
Ronald Berkemeier (Bellevue, KY) German Shepherd Dog
Linda Kaye Brown (Spokane Valley, WA) Multiple Breeds

The AKC’s Management Disciplinary Committee has suspended the following individual from all AKC privileges for ten years, effective April 7, 2008 and imposed a $2000 fine for conduct prejudicial to purebred dogs, purebred dog events, or to the best interests of The American Kennel Club based on their violation of the AKC’s Cruelty Conviction Policy:
Jane Seeley, (Comstock, NY) Collie and Dachshund

The AKC’s Management Disciplinary Committee has suspended the following individuals from all AKC privileges for six months, and imposed a $500 fine for having submitted or caused to be submitted two litter registration applications that they knew, should have known, or had a duty to know contained false certifications (DNA exclusions):
Effective March 10, 2008
Delloy Abplanalp (Lancaster, CA) Siberian Husky, Chihuahua, and Miniature Pinscher
Cindy Patton (Oakdale, LA) Pomeranian and Poodle

Effective April 7, 2008
Jean Bradley (River Ridge, LA) Multiple Breeds

The AKC’s Management Disciplinary Committee has suspended the following individuals from all AKC privileges for an additional six months, and imposed a $500 fine for having submitted or caused to be submitted three litter registration applications that they knew, should have known, or had a duty to know contained false certifications (DNA exclusions):
Effective March 10, 2008
Louise Swindell (Crowley, TX) Multiple Breeds

Effective April 7, 2008
Joy L. Rapp (Shippenville, PA) Multiple Breeds
Merri Chaffin (Atoka, OK) Multiple Breeds

The AKC’s Management Disciplinary Committee has suspended Ms. Brandy Hershberger, Redmond, OR, from AKC registration privileges for one year, effective March 10, 2008, and imposed a fine of $1000 for submission of two online litter registration applications containing a false certification; and for submission of an individual dog registration application containing a false certification (altering the registration status of the dog). The AKC’s Management Disciplinary Committee has suspended Mr. Chuck Kelley, Reynoldsburg, OH, from AKC registration privileges for six months, effective March 17, 2008, and imposed a fine of $500 for submission of an online litter registration application without the written permission of the recorded co-owners of the dam. (Vizsla)

The AKC’s Management Disciplinary Committee has suspended Ms. Jayne Schlegel, Canton, OH, from AKC registration privileges for six months, effective April 7, 2008, and imposed a fine of $500 for submission of a certificate of transfer application containing a false certification as to the signature of the recorded co-owner. (Black and Tan Coonhound and Border Terrier)

The AKC’s Management Disciplinary Committee has suspended Ms. Marci Smith, Paris, KY, from AKC registration privileges for six months, effective April 7, 2008, and imposed a fine of $500 for submission of an online litter registration application without the written permission of the recorded co-owner of the dam. (St. Bernard, Bernese Mountain Dog, and German Shepherd Dog)

During the month of March the DNA program resulted in the correction of 231 litter registrations, affecting 320 registered dogs. Additionally, the registrations of 197 litters, including 284 registered dogs, were converted to conditional registration and the registrations of 4 litters were canceled, affecting 4 registered dogs. 3 litters were canceled as a result of impure breeding, affecting 8 registered dogs.
